Privacy Policy

GENERAL PROVISIONS

1. These provisions of the Privacy Policy concern the establishment of principles for the processing of personal data, in particular the collection, storage and use of personal data of users of the online store. NSBijoux , hereinafter referred to as "Users". The Privacy Policy covers data provided directly by the User.

2. The personal data administrator is Nicole Soszyńska based in Warsaw , code 02-561 , at ul. Jarosława Dąbrowskiego 43 , entered into the register of entrepreneurs by the Minister of Development, Labor and Technology under the Tax Identification Number (NIP): 5213617313 , REGON: 145723335, hereinafter referred to as the "Administrator".

3. The Administrator complies with the principles set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as "GDPR", appropriately protects Users' personal data against unlawful access to personal data by third parties, in particular encrypts personal data, archives personal data, assesses personal data security measures, ensures confidentiality, integrity, availability and resilience of processing systems and services.

4. The User's personal data will be processed solely for the purpose of enabling the use of the online store's functionalities. NSBijoux and for the possible establishment, exercise, or defense against legal claims, for analytical, archiving, and accounting purposes, as well as for the Controller to offer products and services directly to Users (direct marketing). Data for these purposes will be processed on the basis of Article 6(1)(b), (c) and (f) of the GDPR, i.e. when: processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; processing is necessary to comply with a legal obligation to which the controller is subject; processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

5. Processing of Users' personal data for the purpose of marketing products or services of business partners NSBijoux . will only take place after the User has given consent pursuant to Article 6 paragraph 1 letter a) of the GDPR.

6. The user has the right to:

  • a) access to your data and receive a copy thereof;
  • b) rectify (correct) your data;
  • c) deletion of data – if in the User’s opinion there is no basis for us to process his/her data;
  • d) restrict data processing – if you believe that we have incorrect data about you or we process it without justification; or you do not want us to delete it because you need it to establish, pursue or defend claims; or for the duration of your objection to data processing;
  • e) object to the processing of data for the purpose of direct marketing and the right to object to the processing of data based on a legitimate interest for purposes other than direct marketing, as well as when processing is necessary for us to perform a task carried out in the public interest or to exercise public authority entrusted to us;
  • f) data portability – the User has the right to receive from the Controller, in a structured, commonly used and machine-readable format, his/her personal data, which he/she provided to the Controller on the basis of a contract or consent; the User may also instruct the Controller to send this data directly to another entity;
  • g) lodge a complaint with a supervisory authority – if the User believes that we are processing his/her data unlawfully, he/she may lodge a complaint with the President of the Personal Data Protection Office or another competent supervisory authority;
  • h) the right to withdraw consent to the processing of personal data – the user has the right to withdraw consent to the processing of personal data that the Administrator processes based on his/her consent at any time; withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

7. The User provides all data voluntarily and consciously, however, failure to provide basic data necessary to identify the User prevents the provision of services in the form of selling products and any other activities that are the basis for the operation of the online store. NSBijoux .

8. The following categories of entities may have access to the User's personal data:

  • a) authorized employees and associates of the Administrator;
  • b) service providers supplying the Controller with technical and organizational solutions enabling the performance of the contract for the provision of Website functionalities and the management of the Controller's organization (in particular courier and postal companies, entities providing IT and marketing services, legal and advisory service providers and their authorized employees and associates);

9. The Controller will not transfer or authorize the transfer of personal data provided by the User outside the EEA unless it takes measures necessary to ensure that the transfer is compliant with the GDPR. These measures may include, in particular, transferring personal data to a recipient in a country that, in accordance with the European Commission's decision, ensures adequate protection of personal data, or to a recipient in the United States that has certified its compliance with the EU-US Privacy Shield.

10. The Administrator also uses the Google Analytics service to examine, among other things, how Users use the Website and how they reached it.

11. Users' personal data will be processed no longer than necessary, i.e. for the period of having an account on the website. NSBijoux or newsletter subscription, and after deleting or unsubscribing from the newsletter, until the expiry of the limitation period for any claims that the Administrator may raise and that may be brought against the Administrator. Therefore, we will not process data longer than 10 years from account deletion. Personal data processed for the purposes covered by the consent declaration will be processed for these purposes until consent is revoked, and after its withdrawal, until the expiry of the limitation period for any claims that the Administrator may raise and that may be brought against the Administrator.

12. The Administrator has not appointed a Personal Data Protection Officer.


PROVIDING PERSONAL DATA

1. Users of the Administrator's websites, products, and services may, in certain cases, be asked to provide some of their personal data. We only require the data necessary for the proper functioning of the website and the fulfillment of orders. Failure to provide the required data will result in the inability to perform the activity to which the data pertained.


NEWSLETTER SUBSCRIPTIONS

1. Subscription to the electronic newsletter in the online store NSBijoux requires you to provide your email address and consent to receive commercial information electronically. Email addresses obtained this way are added to the Website's mailing list. The email address is required to send the newsletter.


ORDERING SERVICES AND PRODUCTS

1. Ordering services and products offered by the NSBijoux online store requires providing more detailed address information in the appropriate form. Required fields are marked.

UNANNOUNCED NEWS

1. The website reserves the right to send commercial information to persons whose contact details it has and who have agreed to receive them.
2. By commercial information we mean information directly relating to our website (e.g. changes, internal promotions), non-commercial lists and commercial information distributed regarding our products and services.
3. Commercial information is filtered to the extent possible so that the user receives only messages that are of interest to him, their volume is limited and they are sent sporadically.


COOKIES​

1. Online store NSBijoux uses cookies, small text files stored on the customer's computer, identifying them each time they connect to the online store from that computer. Cookies are also used to collect statistical data solely for company purposes. This data does not violate user privacy and is protected from third-party access.
2. It is possible to disable cookies in your web browser options, but please note that this will prevent you from placing an order.
