I GENERAL INFORMATION

The NSBijoux online store is run by:

  1. Shipments are made within Europe

  2. The store issues a fiscal receipt for each order.

  3. Invoices are issued only at the customer's request when placing an order and after providing the company name and Tax Identification Number (NIP). If the company name and NIP number are not provided, the customer will not receive a VAT invoice. VAT invoices are issued in Polish.

  4. The Customer hereby consents to the issuance and transmission, including sharing, of invoices, as well as their corrections and duplicates, in electronic form to the e-mail address provided when placing the order.

  5. If the Customer does not express a desire to receive a VAT invoice, the Customer loses the opportunity to receive it.

  6. All provisions concerning the consumer contained in these Regulations also apply to a natural person concluding a contract directly related to his/her business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by him/her, made available on the basis of the provisions on the Central Register and Information on Business Activity.

II PRODUCT OFFER

  1. The store is obligated to deliver purchased goods free of defects. The store is liable to the buyer if the item sold has a physical or legal defect.

  2. Product prices in the online store are expressed in Polish zloty and include VAT. The price listed for each product is binding at the time the Customer places an order.

  3. The Store reserves the right to change the prices of products on offer, to introduce new products and withdraw existing ones, and to introduce, cancel, or modify promotions. These changes do not apply to orders placed before they are introduced.

  4. A limited number of items are available for promotional sale. Promotional offers cannot be combined unless the specific terms of a specific promotion allow for this.

III. ACCEPTANCE OF ORDERS

  1. Orders are accepted exclusively via the NSBijoux website and Instagram. Orders can be placed 24 hours a day, 7 days a week, all year round.

  2. Placing an order means completing the "order form" available on the store's website and accepting the store's regulations.

  3. Sales will only be made on the basis of a properly completed order process.

  4. After placing an order, each user will receive automatic feedback from NSBijoux confirming that the order has been accepted and forwarded for processing.

  5. Failure to confirm order acceptance means that the order may not have been accepted for execution.

  6. The order will be fulfilled provided the goods are in stock. If some of the goods included in the order are unavailable, the Online Store will send a message to the Customer at the email address provided by the Customer, asking them to make a decision regarding the further course of action regarding the order.

  7. NSBijoux The Customer's provision of the delivery address to which the parcel is to be sent at the ordering stage is considered binding. The Store reserves the right to change the delivery address at the Customer's request, while the parcel is still in the Store. Once the courier accepts the parcel, it is not possible to change the delivery address.

  8. Once the order has been placed, the User cannot modify it.

IV METHOD AND DEADLINE OF PAYMENT

  1. Payment for the ordered goods should be made within 3 days of placing the order. Payment can be made by credit card or electronic transfer. NSBijoux .

V ORDER PROCESSING

  1. Acceptance of the order for execution begins (on business days), depending on the form of payment:
    a) by electronic transfer - after the amount due for the ordered goods has been recorded,
    b) paid by payment card - at the time of transaction authorization

    1. Promotion organizer

    2. Conditions of participation
      a) The promotion is aimed at new newsletter subscribers.
      b) To benefit from the discount, the user must subscribe to the newsletter by providing a valid e-mail address.
      c) After signing up, the user will receive a discount code to the e-mail address provided.
    3. Promotion scope
      a) The discount code entitles you to a 10% discount on the purchase of jewelry available in the online store nsstore.eu
      b) The discount does not apply to other product categories available in the store.
    4. Rules for using the discount code
      a) The discount code is one-time use and valid for 30 days from the date of receipt.
      b) The discount code cannot be exchanged for cash or other benefits.
    5. Final provisions
      a) The Organizer reserves the right to change the terms of the promotion at any time without giving any reason.
      b) If abuse is detected, the organizer has the right to invalidate the discount code.

VIII RIGHT OF WITHDRAWAL FROM THE CONTRACT, COSTS OF RETURNING ITEMS

  1. Information for the Customer who is a consumer regarding:
    a) the manner and deadline for exercising the right to withdraw from the contract
    b) the cost of returning the goods in the event of withdrawal from the contract, which is borne by the consumer. The consumer must use a carrier that insures the shipment against possible damage or breakage during delivery. In the event of damage, the courier company will be financially liable for the damage to the goods.
    c) the costs of returning the goods if, due to their nature, the goods cannot be returned by post in the usual manner

  2. Information regarding the right of withdrawal:

Right of withdrawal:

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the date of delivery of the order – in accordance with Article 27 of the Act of 30 May 2014 on rights.

Returns will not be accepted if the returns form available on the website has not been completed before the goods are shipped to us. nsbijoux.com.pl .

3. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (e.g., a letter sent by post or email). To meet the withdrawal deadline, it is sufficient to send us information concerning your exercise of the right of withdrawal before the expiry of the withdrawal period. If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery, immediately and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of this reimbursement.

4. Instructions on withdrawal from the contract:

The customer does not have the right to withdraw from the contract in relation to contracts:
a) for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has performed the service, he will lose the right to withdraw from the contract;
b) in which the price or remuneration depends on fluctuations in the financial market over which the trader has no control and which may occur before the expiry of the withdrawal period;
c) where the subject of the provision is a non-prefabricated item, manufactured according to the consumer’s specifications or intended to meet his individual needs;
d) where the subject of the performance is an item that spoils quickly or has a short shelf life;
e) where the subject of the service is an item delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;
f) where the subject of the performance are things which, due to their nature, after delivery are inseparably connected with other things;
g) where the subject of the service are alcoholic beverages, the price of which was agreed upon at the conclusion of the sales contract, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the entrepreneur has no control;
h) in which the consumer has expressly requested the trader to come to him for urgent repair or maintenance; if the trader provides additional services other than those requested by the consumer, or supplies items other than spare parts necessary for repair or maintenance, the consumer has the right to withdraw from the contract in respect of additional services or items;
i) where the subject of the provision are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery;
j) for the supply of newspapers, periodicals or magazines, with the exception of subscription agreements;
k) concluded through public auction;
l) for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sporting or cultural events, if the contract specifies the day or period of service provision;
m) for the supply of digital content that is not recorded on a tangible medium, if the performance of the service has begun with the express consent of the consumer before the expiry of the withdrawal period and after the trader has informed the consumer of the loss of the right to withdraw from the contract.

IX COMPLAINTS

  1. The customer has the right to submit a complaint regarding defects in the goods under the terms specified in the Act of 23 April 1964 - Civil Code (Journal of Laws of 2014, item 121). The store does not provide any other additional warranties.

  2. For any complaints, it is recommended to contact NSBijoux via email. In the Store's Contact tab, select the email subject line "COMPLAINTS" and download and complete the complaint form. Please provide the name and surname of the ordering party, order number, proof of purchase number (receipt or VAT invoice), and describe the subject of the complaint and the preferred method of resolving the complaint. The form should be attached to the email and sent to the Store's address. This complaint procedure is recommended and does not exclude the possibility of submitting a complaint in another form permitted by generally applicable law.

  3. The Store will endeavor to process all complaints within a maximum of 14 days from the date the Store receives the complained goods. Pursuant to the Act of 23 April 1964 - Civil Code (Journal of Laws of 2014, item 121), the Store will respond to the request submitted by the customer who is a consumer within 14 days of submitting the complaint.

  4. We reserve the right to refund the customer's money regardless of the payment method chosen by the customer. In the event of a complaint, the Store will refund the customer's money to the account number provided by the customer or via postal order. This information will be agreed with the customer via email.

X OTHER METHODS OF HANDLING COMPLAINTS AND PURSUE CLAIMS

  1. A customer who is a consumer has, among others, the following options for using out-of-court complaint and claim settlement methods:
    a) The Customer is entitled to apply to the permanent consumer arbitration court operating at the Trade Inspection with a request to resolve a dispute arising from the concluded Sales Agreement.
    b) The Customer is entitled to apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings to amicably settle the dispute between the Customer and the Seller.
    c) The Customer may obtain free assistance in resolving a dispute between the Customer and the Seller, also using the free assistance of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.

  2. Detailed information on the possibility for a Customer who is a consumer to use out-of-court complaint and redress procedures and the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection and at the websites of the Office of Competition and Consumer Protection.


XI Consent to sending marketing content

  1. By placing an order on our website and providing your phone number, as well as accepting the terms and conditions of these Terms and Conditions, you consent to receiving marketing communications at the provided phone number, including information about offers, promotions, new products, and other advertising materials related to our company. These communications may be sent via SMS or MMS.

  2. Consent to receiving marketing content is voluntary, but necessary to use the services offered by our company, particularly promotions and current offers. Customers have the right to withdraw their consent at any time by contacting us via the contact form, email, or phone.

  3. This consent is in accordance with the legal provisions on personal data protection, including the Personal Data Protection Act and the GDPR.
